Which Situation
Are You In?

This page covers three different situations each requiring a different approach. Find yours below.

01

My authorized stay is expiring soon

You are still in Canada legally but your authorized period is coming to an end

You need to apply for a Visitor Record an extension of your authorized stay as a visitor. You must apply before your current status expires to remain in Canada legally. If you apply on time, you may be able to stay under maintained status while your extension application is processed.

What to do

Apply for a Visitor Record through your IRCC online account before your authorized stay expires. Include proof of your status, passport, and supporting documents showing why you need to stay longer.

02

My status has already expired

You stayed in Canada beyond your authorized period without an extension application

You may be eligible for Restoration of Status but only if you apply within 90 days of losing your status. Restoration is not guaranteed and is more complex than a simple extension. Acting immediately is critical.

What to do

Apply for restoration of temporary resident status as soon as possible. The application requires a strong explanation of why you overstayed and evidence that you are otherwise eligible to remain in Canada. Do not wait the 90-day window closes quickly.

03

My visitor visa was refused

You applied for a visitor visa or Super Visa from outside Canada and it was refused

A refusal is not permanent you can reapply. But reapplying with the same application rarely works. Understanding exactly why you were refused and addressing those specific concerns is the only way to improve your chances.

What to do

Read your refusal letter carefully. Identify the specific reasons cited. Before reapplying, address each concern with stronger documentation particularly around financial ties to home country, purpose of visit, and financial resources. We help clients interpret refusals and rebuild stronger applications.

Extending Your
Visitor Stay

If you want to stay in Canada longer than your initial authorized period, you must apply for a Visitor Record before your current status expires. Here is what is involved.

1

Check Your Authorized Stay Date

Your authorized stay is typically stamped in your passport when you arrive. If no date is shown, you are generally authorized for 6 months from your date of entry. Check your documents carefully.

2

Apply Before Your Status Expires

Submit your Visitor Record application online through your IRCC account before your authorized stay ends. If you apply on time, you may remain in Canada under maintained status while your application is processed.

3

Provide a Valid Reason to Extend

You must have a legitimate reason to stay longer such as a family situation, medical treatment, or other compelling circumstance. Simply wanting to stay longer is generally not sufficient on its own.

4

Await a Decision

IRCC reviews your application and issues a Visitor Record if approved — showing your new authorized stay date. If refused, you will need to make arrangements to leave Canada by your original date.

Important: If you do not apply before your authorized stay expires and you remain in Canada, you will be out of status. This can have serious consequences for future immigration applications to Canada and other countries.

Why Visitor Visas
Get Refused

Most visitor visa refusals come down to a small number of recurring concerns. Understanding which one applies to your case is the first step to fixing it.

Most Common

Weak Ties to Home Country

Officers were not satisfied that you would leave Canada when your authorized stay ends. Employment, family, property, and financial obligations abroad are key to demonstrating this.

Financial

Insufficient Funds

Your application did not demonstrate enough financial resources to cover your trip accommodation, living costs, and return travel without needing to work in Canada.

Purpose

Unconvincing Purpose of Visit

The reason for the visit was not clearly explained or was inconsistent with other information in the application. A vague or contradictory travel purpose raises officer concerns.

History

Previous Refusals or Violations

Prior visa refusals, immigration violations, or overstays in Canada or other countries weigh against new applications and must be disclosed and addressed directly.

Documents

Incomplete Application

Missing documents, inconsistencies between different parts of the application, or errors in the information provided can lead to refusal even when the applicant is otherwise eligible.

Admissibility

Admissibility Concerns

Criminal history, health conditions, or security concerns that make the applicant inadmissible to Canada some of which can be addressed through a Temporary Resident Permit application.

Extension, Restoration
& Refusal Questions

Hakam Immigration Services helps visitors in Canada and refused applicants abroad understand their options and take the right next step.

Can I stay in Canada while my extension application is being processed?
Yes if you applied before your authorized stay expired, you may remain in Canada under maintained status while IRCC processes your Visitor Record application. Your maintained status ends when a decision is made on your application or if you leave Canada.
What happens if I overstayed and did not apply for an extension?
If you overstayed without applying for an extension, you are out of status. You may be eligible to apply for restoration of status within 90 days of losing it but restoration is not guaranteed. If you leave Canada while out of status, you may face entry difficulties in the future.
Can I reapply for a visitor visa immediately after a refusal?
There is no mandatory waiting period you can reapply immediately. However, submitting the same application again without addressing the reasons for refusal is unlikely to produce a different result. Taking time to strengthen your application is more important than applying quickly.
How do I know why my visitor visa was refused?
IRCC sends a refusal letter that states the reasons for the decision — though the wording is often general and formulaic. We help clients interpret these letters and identify what specifically went wrong in their application based on the language used and their profile.
Does a visitor visa refusal affect other immigration applications?
It can. A refusal becomes part of your immigration history and must be disclosed on future applications. How you address it and whether the underlying concerns have been resolved affects how officers view your subsequent applications. We advise on how to handle prior refusals appropriately in new submissions.
Can I apply to extend my Super Visa from inside Canada?
Yes. If your parents or grandparents are already in Canada on a Super Visa and want to extend their authorized stay beyond the initial period, they can apply for a Visitor Record extension before their current authorized stay expires without needing to leave and re-enter Canada.
